The Federal High Court in Abuja has fixed December 2, 2026, for judgment in a N1 billion fundamental rights suit filed by former Kaduna State Governor, Nasir El-Rufai, against the Independent Corrupt Practices and Other Related Offences Commission (ICPC), Inspector-General of Police and Attorney-General of the Federation.
Justice Joyce Abdulmalik fixed the date after lawyers representing the parties adopted their respective processes in the case.
El-Rufai is seeking N1 billion in damages over the search of his Abuja residence by the ICPC and police in February.
The former governor is asking the court to declare the search a violation of his fundamental rights to dignity, personal liberty, fair hearing and privacy under the 1999 Constitution.
He is also asking the court to prevent the respondents from relying on or tendering items and evidence allegedly recovered during the search in any investigation or prosecution against him.
El-Rufai further wants the court to order the ICPC and police to return the items allegedly seized from his residence and provide a detailed inventory of them.
The ICPC, however, urged the court to dismiss the suit, arguing that the search was carried out pursuant to a valid warrant issued by a competent court.
The commission said the search followed a petition against the former governor and was conducted as part of an ongoing investigation.
The Inspector-General of Police also maintained that its officers acted within their statutory powers and complied with applicable procedures while executing the search warrant.
The Attorney-General of the Federation similarly urged the court to dismiss the suit, arguing that the respondents acted within their lawful duties.
With the parties having adopted their legal arguments, Justice Abdulmalik adjourned the matter until December 2 for judgment.
